DARKFIELD Toronto - Terms of Sale

These are the complete terms for buying and attending DARKFIELD at the Distillery District, Toronto. When you buy a ticket through our checkout, this is the agreement between you and Realscape Productions Inc for that purchase. Our Canadian Terms of Use and Privacy Policy still apply to your general use of our website, but the terms of your ticket purchase are set out here.

Please note: entry is age-restricted (section 2), and section 10 describes the risks you accept, includes a release of liability for personal injury, including our ordinary negligence, and limits the money we can owe you if something goes wrong with your booking or payment. Please read sections 2 and 10 carefully before you buy. Nothing in these terms takes away rights you have under Ontario law that cannot be given up.

1. The experience and who is selling to you

DARKFIELD presents immersive audio experiences staged in complete darkness inside an enclosed shipping container, at the Distillery District, Toronto, Ontario.

The seller of record is Realscape Productions Inc, an Ontario corporation registered for HST. Realscape is named as the seller on your receipt.

These Terms of Sale are a contract between you and Realscape for your ticket purchase.

2. Age, entry and who can attend

• Under 13: not admitted.
• 13 and 14: must be accompanied throughout by a responsible adult aged 18 or over who holds a ticket to the same show and the same session time, and who stays with them for the whole experience.
• 15 and over: may attend unaccompanied.

We run two shows at the same time, in two separate containers. The adult must be booked into the same show, at the same time, and go in with the young person. A ticket to the other show at the same time does not count.

Where a guest is 13 or 14, the person who buys the ticket accepts these terms, including the assumption of risk and release in section 10, on that guest's behalf, and confirms they are authorised to do so. If you are buying for a young person you will not be accompanying yourself, please pass these terms to the accompanying adult before the visit. This does not limit any right the young person has that cannot be given up under Ontario law.

We may ask for proof of age on entry.

Your ticket is permission to attend one specific event, on the date and at the time shown when you buy, and on the conditions shown then. It does not transfer to another event, and we can withdraw it in the situations set out below. We may refuse entry, or require a person to leave, on reasonable safety or conduct grounds - including disruptive behaviour or intoxication - or where a stated age, accompaniment, health or eligibility requirement, or a required acknowledgement, is not met. Where we refuse entry or remove a person on these grounds, no refund is due, except as set out in section 3 or section 6, or where a refund is required by law. If we refuse entry because of a requirement we did not tell you about before you bought, we will refund what you paid for that ticket.

3. Content, health and safety - what you must read

This experience is staged in complete darkness inside an enclosed container and uses binaural (headphone) audio with loud moments. Depending on the show, it may include other sensory effects, including seats that move suddenly without warning.

Each DARKFIELD show has its own content and health warnings, and an acknowledgement that you must read and complete before you pay. That acknowledgement includes your acceptance of the assumption of risk and release of liability in section 10. The specific effects and warnings are set per show; they are not restated here, so please read them carefully before you buy. Admission is conditional on that acknowledgement having been completed.

When you buy, you accept the assumption of risk and release in section 10 for yourself, and you confirm you are authorised to accept these terms for the other guests on your booking.

Please share each show's warnings with everyone coming with you, so they can decide before they arrive.

The Distillery District's interior streets are cobblestone and uneven, and entry to our containers is by a ramp. Fuller access information is in our access pack, which is available from the ticket page before you buy.

Because this is an enclosed shared space, please do not attend if you are unwell or have symptoms of a contagious illness. We do not guarantee a contagion-free environment.

If, acting in good faith, you tell us before entry that you cannot complete the acknowledgement or meet a stated health or eligibility requirement, we will offer you a change to another event or, where that is not possible, a refund of the amount paid for that ticket.

4. Pricing, fees and tax

The price shown for a ticket at checkout is the total price you pay, in Canadian dollars. It is all-inclusive: it includes the ticketing fee and HST at 13%. We will not add undisclosed fees on top of the total shown, and a separate itemised breakdown of fees, service charges and taxes is shown to you before you pay.

The amounts for any optional add-on or change fee are also shown to you at checkout before you choose them. Where nothing is shown, nothing is charged.

Support persons. If you need a support person with you in order to attend because of a disability, there is no charge for their ticket. Please contact us before you book and we will arrange it.

We aim to keep all pricing and event information accurate. Where an obvious pricing or description error has been made, we may correct it and are not obliged to honour the error; if you have already paid, we will offer you the corrected purchase or a full refund.

5. Changing, exchanging or rescheduling your booking

This section applies to tickets bought through our own checkout.

• All tickets are flexible. You can change your booking free of charge up to 24 hours before your event (or, for a two-show bundle, before the first event in it) begins, subject to availability.
• Changing between shows. You may move between SÉANCE and FLIGHT, subject to availability. The age rules in section 2 still apply after any change.
• Optional Flexi add-on. If you add Flexi at checkout, your change window is extended so you can change up to 1 hour before each event begins.
• Changes after your deadline. Once your deadline has passed, we may still be able to move your booking, where we offer that option for your event. If we do, we will show you any fee before you confirm the change, and we will not charge a fee we have not shown you.
• Same or lesser value, or pay the difference. Every change must be to an event of the same or lesser value, unless you move to a higher-priced event and pay the difference.
• Latecomers. Because each show runs to a timed start in darkness, late arrivals may not be admitted once a show has begun, and no refund is due for entry missed through late arrival.

Change of mind is not a refund right. Tickets are not refundable for change of mind. This does not affect the refunds available under section 3 (health and eligibility), section 4 (pricing error) or section 6 (cancellation and material change), or any right you have under Ontario law that cannot be given up.

6. If we cancel or materially change the event

If we cancel your event, make a material change to it (for example a significant change of date, time, format or location), or are unable to complete your event once it has begun, you are entitled to a refund of the amount you paid for the affected ticket. This right applies regardless of any other term.

If the venue is closed to the public, or we are otherwise prevented from running your event by an event beyond our reasonable control (for example a government order, public-health order, fire, severe weather, or other force majeure), we will offer you a change to another date or, if you prefer, a refund of the amount you paid for the affected ticket.

Where a refund is due to you under any part of these Terms of Sale, we refund the full amount you paid for the affected ticket, including the ticketing fee, to your original payment method, within 15 days.

These are contractual entitlements, not discretionary goodwill.

7. Resale

Tickets are sold for personal use. Unauthorised commercial resale or touting is not permitted.

Under Ontario's Ticket Sales Act, 2017, a ticket may not be resold on the secondary market for more than the total price paid when it was bought from us, plus any fees the secondary seller or platform charges. A ticket resold in breach of these terms or of that Act may be cancelled and entry refused, acting reasonably. A ticket cancelled for resale in breach is not refundable, except where the law requires otherwise.

8. You are visiting the Distillery District

The experience takes place within the Distillery District. We hire our site from the District's operators; we do not own or run the District itself.

While you are visiting:

• please follow reasonable directions from our team and from District staff, including on safety, access and where you may go;
• the District is open to the public, and its streets and common areas are shared with other businesses and visitors; and
• the District's owners and operators may have their own rules for visitors, and may operate their own security or recording in their common areas. Those are their arrangements rather than ours, and they are not part of this agreement.

These Terms of Sale cover your DARKFIELD experience and your purchase from us.

9. If you buy through anyone other than us

At present, DARKFIELD Toronto tickets are sold only through our own checkout. If we make tickets available through another seller or platform, that seller's own purchase terms may govern the transaction, and our experience-level terms - what the experience is, the age and entry rules in section 2, and the content and health warnings in section 3 - continue to apply to your attendance.

10. Assumption of risk and release of liability, and limitation of liability

Please read this section carefully. It describes risks you accept and includes a release of liability for personal injury, including our ordinary negligence.

Assumption of risk. Taking part in DARKFIELD involves risks that come with the experience, including but not limited to: anxiety, distress or disorientation from complete darkness and an enclosed space; a claustrophobic reaction; injury from a startled reaction, a sudden movement (including seat movement in some shows), or contact with a surface in the dark; and aggravation of a condition you already have. You take part of your own free will and accept these risks.

Realscape is an occupier of the container and the area we operate at the Distillery District. This release restricts, modifies and excludes our duty of care as occupier under section 3(3) of the Occupiers' Liability Act (Ontario), as well as any other liability.

Release of liability. To the fullest extent permitted by Ontario law, you release, waive, discharge and hold harmless Realscape Productions Inc and its shareholders, directors, officers, employees, agents, contractors and performers, and the owners, operators and managers of the Distillery District and their respective affiliates, personnel, agents, officers, directors and employees (together, the "Released Parties"), from any and all claims for loss, injury, harm or death arising out of or in any way connected with your attendance - including claims based on the Released Parties' ordinary negligence - and you agree not to bring any such claim.

What you keep. This release does not apply to - and you keep every right to claim for - loss, injury, harm or death caused by gross negligence, recklessness, fraud or deliberate wrongdoing. It does not limit any right you have that cannot be given up under Ontario law, and it does not limit the rights of a person under 18 that cannot be given up.

Everyone in your booking. When you buy, you confirm you are authorised to accept these terms for the other guests on your booking, and you agree to share each show's warnings with them.

We accept the benefit of this release for ourselves and, as agent and trustee, for each of the other Released Parties, each of whom may enforce it.

Disclaimers and money limit. To the fullest extent permitted by law, and subject to the rights you keep above:

• our website and online services are provided on an "as is" and "as available" basis, and we make no warranty that they will be uninterrupted or error-free;
• we are not liable for any indirect, incidental, special, consequential, exemplary or punitive loss, or for any lost profits or wasted expenditure, arising out of or relating to your use of our website; and
• if your claim is about money or your booking rather than injury - for example a booking, payment, fulfilment, pricing or service issue - our total liability to you will not exceed the total amount you paid us for the ticket or tickets the claim is about, or one hundred Canadian dollars (CAD $100) if you paid nothing.

None of the limits above applies to a claim for personal injury, illness or death. Those claims are dealt with under the release above, and no financial limit applies to them.

11. Governing law and disputes

These Terms of Sale and your purchase are governed by the laws of the Province of Ontario and the laws of Canada applicable in Ontario. You and Realscape submit to the courts of Ontario.

There is no mandatory arbitration clause and no class-action waiver in these Terms. Disputes are resolved in court.

If something has gone wrong, please contact us first at hello@realscapeproductions.com - most issues are resolved that way.

12. Severability

If any provision of these Terms of Sale is held invalid or unenforceable, that provision is limited or removed to the minimum extent necessary, and the remaining provisions stay in full force.

13. How you agree to these Terms of Sale

When you buy a DARKFIELD Toronto ticket through our checkout, you agree to these Terms of Sale (shown to you as their own link before you pay), you accept the assumption of risk and release in section 10, and you complete the show-specific acknowledgement described in section 3. Our Canadian Terms of Use and Privacy Policy continue to apply to your general use of our website.

14. Changes to these Terms of Sale

We may update these Terms of Sale from time to time. We will change the "last updated" date below, and the terms that apply to your purchase are the ones in effect when you buy. Where a change materially affects your rights, we will take reasonable steps to make it prominent. Previous versions are available on request.
