DARKFIELD Las Vegas - Terms of Sale
These are the complete terms for buying and attending DARKFIELD at AREA15, Las Vegas. When you buy a ticket through our checkout, this is the agreement between you and Realscape Productions LLC for that purchase - everything that governs your ticket is in this one document. Our general Website Terms of Use and Privacy Policy still apply to your general use of our website (browsing, accounts, and our intellectual property), but the terms of your ticket purchase are set out here.
Please note: entry is age-restricted (section 2); section 10 describes the risks you accept, includes a release of liability for personal injury - including our ordinary negligence (each person attending accepts this for themselves), and limits the money we can owe you; and section 11 requires most disputes to go to individual arbitration and waives class actions (you can opt out within 30 days). Personal-injury claims are dealt with under section 10 and go to court, not arbitration. Please read sections 2, 10 and 11 carefully.
1. The experience and who is selling to you
DARKFIELD presents immersive audio experiences staged in complete darkness inside an enclosed container, at the AREA15 District, 3215 S Rancho Dr, Las Vegas, Nevada.
When you buy through our own checkout, the seller of record is Realscape Productions LLC, a Delaware limited liability company operating under Nevada and Clark County business licensing. Realscape is named as the seller on your receipt. (If you buy through an AREA15 Experience Pass or voucher instead, AREA15 is the seller - see section 9.)
These Terms of Sale are a contract between you and Realscape for your ticket purchase. Where you also use our website generally, our Website Terms of Use and Privacy Policy cover that general use; they do not change the purchase terms set out here.
2. Age, entry and who can attend
- Under 13: not admitted.
- 13 to 17: must be accompanied throughout by a ticket-holding adult (18 or over).
- 18 and over: no age restriction.
Ages are confirmed as part of buying, and we may ask for proof of age on entry.
Your ticket is a limited, revocable licence to attend the specific event, on the date and time and subject to the conditions shown when you buy. We may refuse entry, or require a person to leave, on reasonable safety or conduct grounds - including disruptive behaviour or intoxication - or where a stated age, accompaniment, health or eligibility requirement or a required acknowledgement is not met. Where we refuse entry or remove a person on these grounds, no refund is due.
3. Content, health and safety - what you must read and complete
This experience is staged in complete darkness inside an enclosed container and uses binaural (headphone) audio with loud moments. Depending on the show, it may also include other sensory effects, which vary from show to show and are set out in that show's warnings.
Each DARKFIELD show has its own content and health warnings and a participation acknowledgement that you must read and complete - shown to you for that show before you pay, and again at check-in. The specific effects, warnings, acknowledgements and any participation conditions are set per show and shown to you for that show; they are not restated here, so please read them carefully before you buy and before you enter. Admission is conditional on completing the required acknowledgement. For a guest aged 13 to 17, the required acknowledgement is completed by the accompanying adult as an admission, age, content and suitability acknowledgement. This does not limit any right a minor has that cannot be waived under Nevada law.
When you buy, you accept the assumption of risk and release in section 10 for yourself, and you confirm you are authorised to accept these terms for the other guests on your booking. Each person attending also accepts that assumption of risk and release for themselves before entry - by email before you arrive, at checkout, or at check-in (for a guest aged 13 to 17, the accompanying adult accepts it for them). Please share each show's warnings with everyone coming with you, so they can decide before they arrive.
Because this is an enclosed shared space, please do not attend if you are unwell or have symptoms of a contagious illness. We do not guarantee a contagion-free environment.
If, acting in good faith, you tell us before entry that you cannot complete the acknowledgement or meet a stated health or eligibility requirement (for example a contraindication you become aware of), we will offer you a change to another event or, where that is not possible, a refund (or, if you prefer, a credit) of the amount paid for that ticket.
4. Pricing and fees
The price shown for a ticket at checkout is the total price you pay, in US dollars. It includes any applicable ticketing, service or booking fee - reflected in that total and shown to you before you pay. We will not add undisclosed fees on top of the total shown. Where tax applies, it is shown to you before you pay (included in the total, or added as a separate line, as the checkout indicates).
The amounts for any optional add-on, change or on-the-day fee are also shown to you at checkout before you choose them.
We aim to keep all pricing and event information accurate. Where an obvious pricing or description error has been made, we may correct it and are not obliged to honour the error; if you have already paid, we will offer you the corrected purchase or a full refund.
5. Changing, exchanging or rescheduling your booking
These terms apply to tickets bought through our own checkout. The amounts for any change or add-on are shown to you at checkout.
- All tickets are flexible. You can change your booking free of charge up to 24 hours before your event (or, for a bundle, before the first event in it) begins, subject to availability.
- Optional Flexi add-on. If you add Flexi at checkout, your change window is extended so you can change up to 1 hour before each event begins.
- Changes after the deadline. Once your applicable deadline has passed, you can still change on the day of the event for a fee (the fee is shown at checkout).
- Same or lesser value, or pay the difference. Every change must be to an event of the same or lesser value, unless you move to a higher-priced event and pay the difference.
- Re-attend within 48 hours. Any on-the-day change must be re-attended within 48 hours of your original booking time.
- Latecomers. Because each show runs to a timed start in darkness, late arrivals may not be admitted once a show has begun, and no refund is due for entry missed through late arrival.
Change of mind is not a refund right. Outside the cancellation or material-change situation in section 6, tickets are not refundable for change of mind.
6. If we cancel or materially change the event
If we cancel your event, or make a material change to it (for example a significant change of date, time, format or location), you are entitled to a refund of the amount you paid for the affected ticket. This right applies regardless of any other term.
If the AREA15 venue is closed to the public, or we are otherwise prevented from running your event by an event beyond our reasonable control (for example a venue buyout, government order, public-health order, fire, severe weather, or other force majeure), we will offer you a change to another date or, if you prefer, a refund of the amount you paid for the affected ticket.
We honour these refund rights as our stated policy, and we apply them honestly.
7. Resale
Tickets are sold for personal use. Unauthorised commercial resale or touting is not permitted. Any permitted resale must comply with Nevada and Clark County law and with these terms; a ticket resold in breach may be cancelled and entry refused, acting reasonably. A ticket cancelled for resale in breach is not refundable, except where the law requires otherwise.
8. You are visiting the AREA15 District
The experience takes place inside the AREA15 District. While you are there, your visit is also subject to AREA15's own venue rules - including its code of conduct, security and bag screening, its privacy notice, and its filming and photography policy (AREA15 records in its common areas, and entry to the District is taken as your consent to that recording). These are AREA15's rules for visiting the District, not ours; please review them at area15.com (for example area15.com/code-of-conduct and area15.com/privacy-policy). AREA15's separate ticketing terms apply only if you buy through an AREA15 Experience Pass or voucher (section 9); they do not govern the tickets you buy from us. Our Terms of Sale here cover only your DARKFIELD experience and your purchase from us.
9. If you buy through an AREA15 Experience Pass or voucher
Sometimes a guest buys access to DARKFIELD through an AREA15 Experience Pass or voucher rather than through our checkout. When you do:
- AREA15 is the seller of record for that purchase, and AREA15's ticketing terms (area15.com/ticketing-terms) govern the purchase, payment, cancellation and refund - including AREA15's own dispute-resolution terms and AREA15's position that a multi-experience pass may be non-refundable under AREA15's terms;
- any cancellation or refund request for that purchase must go to AREA15, not to Realscape; and
- our experience-level information still applies - what the experience is, the age and entry rules (section 2), and the content/health warnings and acknowledgements you must complete (section 3).
Your DARKFIELD experience itself, and any dispute about that experience with Realscape (as distinct from your purchase from AREA15), remain governed by Nevada law. A non-injury dispute is resolved as set out in section 11; a personal-injury claim is governed by the assumption of risk and release in section 10 and the courts of Clark County, Nevada (section 12). Because you did not buy through our checkout, you accept that assumption of risk and release (section 10) at check-in before entry. Our flexible-change and Flexi policy in section 5 applies only to tickets bought through our own checkout, not to AREA15 Pass or voucher purchases.
10. Assumption of risk and release of liability (including our ordinary negligence), and limitation of liability
Please read this section carefully. It describes risks you accept, a release of liability for personal injury (including our ordinary negligence), and a limit on the money we can owe you. Each person attending accepts the assumption of risk and release for themselves before entry (sections 3 and 13).
Assumption of risk. Taking part in DARKFIELD involves risks that come with the experience, including but not limited to: anxiety or distress from complete darkness and an enclosed space; disorientation, dizziness or nausea from the binaural audio; a claustrophobic reaction; injury from a startled reaction, a sudden movement, or contact with a surface in the dark; aggravation of a condition you already have; and motion sickness, particularly in shows where your seat moves. You take part of your own free will and accept these risks.
Release of liability. To the fullest extent permitted by Nevada law, you release, waive, discharge and hold harmless Realscape Productions LLC and its members, managers, officers, employees, agents, contractors and performers, and Area 15 Las Vegas LLC and FBLV District 2 LLC and their respective affiliates, lenders, personnel, agents, officers, directors, members, managers and employees (together, the "Released Parties"), from any and all claims for loss, injury, harm or death arising out of or in any way connected with your attendance - including claims based on the Released Parties' ordinary negligence - and you agree not to bring or join any such claim.
What you keep. This release does not apply to - and you keep every right to claim for - loss, injury, harm or death caused by gross negligence, recklessness, fraud or deliberate wrongdoing, and it does not limit any right you have that cannot be given up under Nevada law, including under the Nevada Deceptive Trade Practices Act (NRS Chapter 598) and NRS 41.600 and any related statutory attorney's fees.
Everyone in your booking. When you buy, you confirm you are authorised to accept these terms for the other guests on your booking, and you agree to share each show's warnings with them. Each person attending accepts the assumption of risk and release above for themselves before entry - we capture this from each guest by email before you arrive, at checkout, or at check-in. For a guest aged 13 to 17, the accompanying adult accepts it for them; this does not limit any right the young person has that cannot be given up under Nevada law.
Disclaimers and money limit. To the fullest extent permitted by law, and subject to the rights you keep above:
- our website and online services are provided on an "as is" and "as available" basis, and we make no warranty of any kind about them, including any implied warranty of merchantability or fitness for a particular purpose, or that they will be uninterrupted or error-free;
- we are not liable for any indirect, incidental, special, consequential, exemplary or punitive loss, or for any lost profits, lost enjoyment, or wasted expenditure, arising out of or relating to your ticket or your use of our website; and
- our total liability to you for any economic or transactional dispute connected with your ticket - for example a booking, payment, fulfilment, pricing or service issue - will not exceed the total amount you paid us for the ticket(s) giving rise to the claim, or one hundred US dollars ($100) if you paid nothing.
Any personal-injury claim that you keep under this section is dealt with by Nevada law and our insurance, and is resolved in the courts of Clark County, Nevada (section 12), not by arbitration.
11. Dispute resolution - arbitration and class-action waiver
Please read this section carefully. For most disputes between you and Realscape, it requires binding individual arbitration, it waives class actions, and it gives you a right to opt out within 30 days. It does NOT cover personal-injury claims, which go to court (section 12).
(a) Talk to us first. Before starting an arbitration, you agree to contact us at hello@realscapeproductions.com and give us 30 days to try to resolve the dispute informally. Most issues are resolved at this stage.
(b) Binding arbitration. If we cannot resolve it informally, any dispute arising out of or relating to your ticket purchase or these Terms of Sale - except a claim for bodily or personal injury arising from attendance, which is governed by the assumption of risk and release in section 10 and resolved in the courts of Clark County, Nevada (section 12) - will be resolved by final and binding arbitration administered by JAMS under its applicable rules, before a single arbitrator, seated in Las Vegas, Nevada. The Federal Arbitration Act governs the interpretation and enforcement of this section. Any consumer arbitration will be administered under the JAMS Consumer Arbitration Minimum Standards, and Realscape will pay all JAMS administrative and arbitrator fees that exceed the consumer's initial filing fee.
(c) Class-action waiver. You and Realscape agree that each may bring claims against the other only in an individual capacity, and not as a plaintiff or class member in any purported class, collective, consolidated or representative proceeding. The arbitrator may not consolidate more than one person's claims or preside over any form of class proceeding. If this class-action waiver is held unenforceable as to any claim, that claim alone will proceed in the courts of Clark County, Nevada, and the remainder of this section stays in effect.
(d) Your right to opt out. You may opt out of this section 11 (arbitration and class-action waiver) within 30 days of any DARKFIELD Las Vegas ticket purchase, as to disputes arising from that purchase, by emailing hello@realscapeproductions.com with your name and order details. We will confirm your opt-out by email. If you opt out, disputes are resolved in the courts identified in paragraph (g). Opting out does not affect any other part of these Terms of Sale.
(e) Exceptions. Either you or Realscape may bring an individual claim in a small-claims court that has jurisdiction, instead of arbitration. Either party may also seek temporary or preliminary injunctive relief in the courts of Clark County, Nevada in aid of arbitration, on any claim, pending the arbitrator's decision.
(f) Guests on your booking. If you buy tickets for other guests, you accept this section 11 on their behalf and confirm you are authorised to do so, and it applies to every guest admitted on the booking. Each guest aged 18 or over may opt out for themselves under paragraph (d).
(g) Governing law and courts. These Terms of Sale and your purchase are governed by the laws of the State of Nevada, without regard to its conflict-of-laws rules. For any matter that is not subject to arbitration (including matters under paragraphs (e) and the injury carve-out in (b), or if you opt out under paragraph (d)), you and Realscape submit to the courts of Clark County, Nevada.
12. Severability and personal-injury claims
If any provision of these Terms of Sale is held invalid or unenforceable, that provision is limited or removed to the minimum extent necessary, and the remaining provisions stay in full force.
Personal-injury claims are governed by the assumption of risk and release in section 10 and applicable Nevada law, and are resolved in the courts of Clark County, Nevada - they are not subject to the arbitration in section 11.
13. How you agree to these Terms of Sale
When you buy a DARKFIELD Las Vegas ticket through our checkout, you agree to these Terms of Sale (shown to you as their own link before you pay), you accept the assumption of risk and release in section 10, and you complete the show-specific acknowledgement described in section 3. Each person attending also accepts the assumption of risk and release before entry (section 10). Our Website Terms of Use and Privacy Policy continue to apply to your general use of our website.
14. Changes to these Terms of Sale
We may update these Terms of Sale from time to time. We will change the "last updated" date below, and the terms that apply to your purchase are the ones in effect when you buy. Where a change materially affects your rights, we will take reasonable steps to make it prominent. Previous versions are available on request.
